tax payments regarding a family legal settlement

My father passed away recently and there was a dispute regarding one of his assets. At his request, I have entered into a legal agreement with his widow (partner, not wife) to pay her a percentage of the income that I receive from a trust. I don't want to be liable for 100% of the tax as I am only receiving 75% of the income. Am I able to deduct this from my taxable income and issue her a misc 1099?
