My son owns his primary home with no mortgage ON THAT PROPERTY. (Purchased a few months before ANY of the buyer credits.)
Can he have his girlfriend (serious, stable relationship, of course) added to the deed on this home, which will be her primary residence, and she will qualify for the $8000 first time home buyer credit? Or will it disqualify her because it would be considered a gift? If they married, SHE won't qualify because HE doesn't qualify, right?
My son does owe money for the purchase of this house. The money was borrowed against a different piece of property. (Banks didn't like the fixer-upper status of the primary residence.) The girlfriend would be part of this obligation on the other property, as well. So it really isn't a gift. Does the IRS/GOV care about a person's particular mortgage arrangements on qualifying primary residence property?
$8000 would sure help do more of the fixer-upping!!!
