understanding the residency test for qualifying child My daughter was a full time student Jan-May 2016. She graduated in May. she was the editor for the college yearbook, so after school ended, she volunteered her time and continued to work for them through June, living with a friend for the month of june. On July 1st she moved into a house (not our house) because rather than come home, she wanted to try and find a job in the same area as her college was. We continued to pay for a majority of her expenses. She found a full time job on Sep 26th 2016.
The IRS guidelines state there are exceptions to the residency test:
illness, education, business, vacation, military service, or juvenile detention. We know that 5 months are under the education exception, but what about months 6 and 7? could the argument be made she was still engaged in either school or business while volunteering at the year book? And would it be considered business if she was looking for a job? |
