I received a letter last year from Wisconsin IRS saying that they have been trying to reach me since 2000 over money I owe to the court for fines. I owe no taxes to Wisconsin. My questions are what is the statute of limitations and can they take my fed refund? ================>> Claim for refund of an overpayment of any tax imposed by the taxpayer is required to file a return shall be filed by the taxpayer within 3 years from the time the return was filed or 2 years from the time the tax was paid, whichever of such periods expires the later, or if no return was filed by the taxpayer, within 2 years from the time the tax was paid. Say, A files his 2014 tax return on July 1, 2015. There was no extension filed. Since the return statutory due date was due April 15, 2015 and July 1, 2015 is later than the statutory due date, the statute of limitations expiration date for tax assessment is July 1, 2018, I mean 3years from the time the return was filed
I have not been to Wisconsin in over 10 years.
Ive had several attorneys say statute of limitations should have passed.=============.As mentioned above |
