Then, Sorry, no you can’t; A spouse is NEVER a dependent.However,you can claim his personal exemption, $3,650 for 2010, on your 2010 return if you file your return as married filing jointly. Just for reference, you and yur husband are considered married for income tax purposes until a divorce is completely and utterly final, or there is a legal separation (separate maintenance decree). Other than those situations, you must consider yourselves married, and two of the five filing statuses are possibilities for you: married filing jointly or married filing separately. |
