“I am a realtor that received a referral fee for a closing in 2011. They issued and I received the check Jan 11 2012. They sent me a 1099 for the income for 2011. I questioned whether this is correct and should it be voided and send the 1099 for 2012.”--> The 1099 due date is January 31 of every year. As a cash basis taxpayer, you need to report your referral fee income on your 2012 return( as you actually received the fee, the check , in 2012, NOT in 2011), NOT on your 2011 return; a taxpayer who reports income and deductions in the year that they are actually paid or received. Cash basis taxpayers cannot report receivables as income, nor deduct promissory notes as payments.
“ALSO, they mistakenly sent me two different 1099's. I certainly don't want to pay on that income twice but I haven't had response from them about either issue. Shall I just pay on what I think is correct?”---> Y ou need to contact the payer that issued the 1099-MISC to you and ask them to correct/cancel th e wrong 1099-MISC. If they do NOT do it( for example, say they already submitted both 1099s and 1096 to the IRs), then you just report the amount on 1099 box 7 on Sch C of 1040 line 1b, I guess, and the also report the exactly same amount on Sch C line 1 b on line 27a.You do NOT need to pay SECA taxes /quarterly estimated taxes on the amount .
