You are the individual filing thatreturn, and affirming its accuracy and honesty.You are responsible for any penalties incurred because of unreported income, and if an audit is ever conducted, you will face penalties if it has been determined that earned income was not reported.So as you said, you needed to report the whole income that actually had to be reported, $100K, NOT $50K. Even if you don't get a 1099 form, you must still file your tax return by April 15, or file an extension. It is required by law to include the amount of income earned in your tax return, even if you have not received a 1099 form from the employer. Include an explanatory statement regarding the incorrect 1099-MISC.There are two possibilities: Your records are incorrect,and you'll be reporting too-much income *or* the issuer ofthe 1099 made a mistake. In the latter case, a corrected1099 may be on the way, and you'll just have to file anamended return later. In the former, you'll be paying toomuch SE tax.Seems it would be wiser to contact the issuer, and reviewyour records in comparison with theirs thus finding the error and fixing it.. Then you can file a correct return,and never have to worry about it. You need to let your tax pro know this.
“This is an ex-company of mine so I wouldn't be surprised if they did this on purpose to mess with me as well”======>Call your former employer and remind them you haven worked for them from JA –Dec 2012 and request they issue a corrected 1099 showing the amount paid to you in 2012 as $100K. If the ER doesn’t want to give it a corrected 1099; If you want to report to the IRS that you received an incorrect 1099.the ER’d be subject to penalty; if you kept good records (check stubs, invoices, etc.) of the work done and payment received, you should be OK. If you believe the form is fraudulent, it can be reported to IRS fraud division; |
