I guess it depends on the situation;you and your KIDS must live with your BF the ENTIRE YEAR;your gross income must be less than $3.9K in 2013;you didn’t file joint return with your spouse. For the kids, youmust be their custodial parent; the custodial parent has the legal right to claim the child as a dependent and to claim credit for which she qualifies, such as the earned income credit, the noncustodial parent may only claim the child in limited situations, so UNLESS your spouse is their custodial parent, your BF, aslongas he meets the requirements as described above, can claim all of you on hisreturn
