My Spouse was claimed as a dependent by her parent I started a small business late last year. I live at home of spouse's parents. No income, just expenses paid to get the business started (almost $3k). That said, there is no tax liability - no refund either. Unknown to me, my wife's parents claimed her as a dependent . She has no income either. I want to file jointly forfeiting my wife's exemption as it has already been taken. It won't change my tax situation either way. I know I am not required to file per IRS rules but I really do need to file a joint return with my wife to have on record.
According to Publication 501, an exemption can be claimed for a person who files a joint return if that person and his or her spouse file the joint return only to claim a refund of income tax withheld or estimated tax paid.
Only catch here is that I wouldn't be getting a refund. I won't be owing either. Can I still file jointly with my wife? |
